1. Who Winda is

This Privacy Policy explains how Winda Inc. ("Winda") collects and uses personal data through the Winda website at winda.ai (the "Site").

Winda Inc. is a Texas corporation. Its address is 2700 Post Oak Blvd, Galleria Office Tower I, Houston, TX 77056, United States. Winda is responsible for the personal data described in this policy.

The Site is for business visitors in the oil and gas industry. This policy covers the Site only. Winda's products and services are governed by their own agreements.

2. What data Winda collects

Winda collects personal data in 3 ways.

Data a visitor provides through the contact form. The form on the Contact page asks for:

  • name, work email and company (required)
  • role (optional)
  • a free-text description of the visitor's scenario or message
  • the topic the visitor chooses

Sample output requests. A visitor asks for a product's sample output through the same contact form, with the sample named as its topic, so the data above applies and Winda uses it to send the requested sample.

Campaign data sent with a form. When a visitor arrives at the Site from a link that carries campaign details, the Site keeps those details in the browser for the visit and sends them with any form the visitor submits. This data can include:

  • campaign tags added to links (utm_source, utm_medium, utm_campaign, utm_term and utm_content)
  • click identifiers added to links by advertising platforms (gclid and li_fat_id)
  • the first page the visitor landed on during the visit
  • the referring address, meaning the page that linked to the Site

Only the first set of campaign details in a visit is kept. Campaign data reaches Winda only when a visitor submits a form.

Technical data. Like any website, the Site is delivered by servers that receive the technical information a browser sends with each request, such as IP address, browser type and the page requested. The files the Site uses, its 3D graphics library and its fonts included, are served from the Site itself. The Cookie Policy describes what the Site stores in the browser.

The Site sets no advertising or analytics cookies and loads no analytics script. The Cookie Policy lists everything the Site stores in the browser.

3. How Winda uses the data

Winda uses personal data to:

  • reply to inquiries sent through the contact form, including meeting and demo requests
  • send the sample outputs that visitors request
  • understand which campaigns and links bring inquiries to Winda, so that Winda can plan its outreach
  • keep the Site and its forms secure, and detect and prevent spam, abuse and fraud
  • meet legal obligations and protect Winda's legal rights

Winda does not sell personal data. Winda does not share personal data for advertising that follows a person across other companies' sites and apps. Winda does not make decisions about a person based solely on automated processing of the data collected through the Site.

4. Legal bases

Where the law requires a legal basis for using personal data, Winda relies on the following:

  • Steps requested by the person. Replying to an inquiry and sending a requested sample are steps a person asks Winda to take, including steps before any contract.
  • Legitimate interests. Winda has a legitimate interest in answering business inquiries, understanding which campaigns bring inquiries and keeping the Site secure. Winda balances these interests against the rights of the people concerned.
  • Consent. Where the law requires consent, for example for non-essential cookies or for some marketing emails, Winda will ask for it first. A person can withdraw consent at any time.
  • Legal obligation. Winda may use or keep data where the law requires it.

5. Sharing

Winda shares personal data only as described here:

  • Service providers. Service providers that host the Site and process form submissions on Winda's behalf receive the data needed to perform those services. They act on Winda's instructions.
  • Legal requirements. Winda may disclose data where the law, a court order or a government authority requires it, or where disclosure is needed to protect the rights, property or safety of Winda, its users or others.
  • Business transfers. If Winda is involved in a merger, acquisition, financing or sale of assets, personal data may be transferred as part of that transaction. This policy will continue to apply to that data, or the people concerned will be told of any change.

6. Retention

Winda keeps personal data for as long as it is needed for the purpose it was collected for. To decide how long that is, Winda considers:

  • whether the inquiry or sample request is still open, or a business relationship with the person or their company continues
  • whether the data is needed to understand the results of a campaign
  • whether the law requires Winda to keep the data for a set time
  • whether the data is needed to resolve a dispute or to protect Winda's legal rights

When data is no longer needed, Winda deletes it or makes it anonymous.

7. International transfers

Winda is based in the United States, and its service providers may process data in other countries. Data protection laws in those countries may differ from the laws where a visitor lives. Where the law requires it, Winda uses appropriate safeguards for these transfers, such as standard contractual clauses approved by the relevant authorities.

8. Rights

Depending on where a person lives, the law may give them the right to:

  • access the personal data Winda holds about them, and receive a copy
  • correct data that is inaccurate or incomplete
  • delete their data
  • object to Winda's use of their data, or ask Winda to restrict it
  • opt out of marketing at any time
  • withdraw consent where Winda relies on consent
  • move their data to another organization, where the law provides for it

To exercise any of these rights, a person can write to legal@winda.ai. Winda may need to confirm the person's identity before acting on a request. Winda will not treat anyone differently for exercising these rights.

Any marketing email from Winda will also include a way to unsubscribe.

A person who is unhappy with how Winda has handled their data can also complain to the data protection authority where they live.

9. Security

Winda uses reasonable technical and organizational measures to protect personal data against loss, misuse and unauthorized access. These include sending form data over encrypted connections and limiting access to the people and service providers who need it. No method of transmission or storage is fully secure, so Winda cannot guarantee absolute security.

Visitors should not send confidential or sensitive information through the Site's forms.

10. Children

The Site is for business visitors and is not directed at children. Winda does not knowingly collect personal data from children. If Winda learns that it has collected a child's personal data, it will delete that data. Anyone who believes a child has sent data to Winda can write to legal@winda.ai.

11. Changes to this policy

Winda may update this policy when the Site or the law changes. The date at the top shows when the policy last changed. If a change is significant, Winda will post a clear notice on the Site.
